We have created this privacy policy to explain our privacy practices in connection with the websites https://www.yotspot.com and https://www.yotspotconnect.com ("Website"), as well as the Yotspot Connect App. This privacy policy outlines when and how personal information is collected, used, disclosed and protected with respect to our services as provided via the Website or the Yotspot Connect App ("Services").

    CBMG respects your privacy and is committed to protecting your personal data. This privacy policy will inform you as to how we look after your personal data when you visit our Website (regardless of where you visit it from), or use the Yotspot Connect App, and tell you about your privacy rights and how the law protects you.

    By using the Services, you consent to this privacy policy. We reserve the right to change this privacy policy at any time. If we make any changes to our privacy policy, we will post a new privacy policy on our Website and update the "last updated" date set above. Therefore, we encourage you to check our privacy policy whenever you use the Service to see if it has been updated since your last visit. We will use information in accordance with the most up to date privacy policy.

    This privacy policy aims to give you information on how CBMG collects and processes your personal data through your use of the Website or the Services, including any data you may provide through the Website when you sign up to use the Services.

    The Website is not intended for children and we do not knowingly collect data relating to children.

    It is important that you read this privacy policy together with any other privacy policy or fair processing policy we may provide on specific occasions when we are collecting or processing personal data about you so that you are fully aware of how and why we are using your data. This privacy policy supplements other notices and privacy policies and is not intended to override them.

    It is important that the personal data we hold about you is accurate and current. Please keep us informed if your personal data changes during your relationship with us.

    The Website may include links to third-party websites, plug-ins and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. We do not control these third-party websites and are not responsible for their privacy statements. When you leave our Website, we encourage you to read the privacy policy of every website you visit.

    2. The data we collect about you

    We collect two basic types of information in connection with our Services: "Personal Information" and "Aggregate Information".

    • Personal Information is personal data and information about an individual from which that person can be identified and that is directly associated with a specific person or entity such as a user's name, postal or zip code, geographical location, user-chosen ID and password, or information about activities that is directly linked to that person. Personal Information does not include Aggregate Information.
    • Aggregate Information is data we collect about a group or category of services or users from which individual user identities have been removed and does not directly or indirectly reveal your identity. In other words, information on how you use our Services may be collected and combined with information about how others use the Services, but no Personal Information will be included in the resulting data. Aggregate Information helps us understand trends in our users' needs so that we can better consider new features or otherwise tailor our Services. We may share Aggregate Information about our users with third parties for various purposes, including helping us better understand and improve our Services, and for advertising and marketing purposes.

    We do not collect any special categories of personal data about you (this includes details about your religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health beyond whether you hold a valid ENG1 certificate, and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.

    For the avoidance of doubt however, we do provide an option for you to provide us with details as to your race or ethnicity. This information is not displayed publicly, and is collected by us only to internally track diversity amongst users. Should you choose to provide such details to us, you acknowledge that you are giving us consent to process such special category of data in accordance with Article 9(2)(a) for the purposes of us internally tracking diversity amongst our users. By entering your Ethnicity you are opt-ing in to specifically confirm your consent at the time you provide this data. You may remove this information from your profile at any time, and such data shall immediately be deleted from our records.

    Please note that we do not collect information about your health, although we do hold information as to whether you hold a valid ENG1 certificate deeming you medically fit to work at sea.

    3. How is your Personal Information and Aggregate Information collected?

    Information you give us

    We collect Personal Information and Aggregate Information at various times when you register with us and use our Services. Examples include the following:

    • Registration & Transaction Information: When you register to use the Services, we may collect contact Personal Information about you including, for example, your name and location, and you will be asked to create a user-chosen ID and password for your use when accessing the Services. In addition, we may collect images, pictures, data files, and written descriptions or statements about you.
    • Submissions & Customer Service: We may collect Personal Information that identifies you personally when you send us comments, questions or suggestions, or if you send to us job applications, resumes, or other business-related contacts.
    • Automatically Collected Information: We automatically receive certain types of information whenever you interact with us. For example, when you use the Services, our systems automatically collect your IP address and the type of browser you use. We may also collect standard access information, such as time and date of accessing the Services, and usage of the Services. We use such information to help manage the effectiveness of our online advertising and to gather access information, such as counting the users who have visited those pages and compiling aggregated statistics about service usage.

    If you fail to provide Personal Information

    Where we need to collect Personal Information by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with the Services). In this case, we may have to cancel the Services you have with us but we will notify you if this is the case at the time.

    4. How we use your Personal Information

    We will only use your Personal Information when the law allows us to. Most commonly, we will use your Personal Information in the following circumstances:

    • Where we need to perform the contract we are about to enter into or have entered into with you.
    • Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.
    • Where we need to comply with a legal obligation.

    We will get your consent before sending third party direct marketing communications to you via e-mail or text message. You have the right to withdraw consent to marketing at any time by contacting us.

    Purposes for which we will use your Personal Information

    In general, we use Personal Information internally to serve you and enable you to take maximum advantage of our Services.

    For example, to provide services or complete transactions you have requested, to anticipate and resolve problems with our Services, to respond to customer support inquiries, and to create and inform you of new products and services from CBMG that better meet your needs. We reserve the right to communicate with you from time to time at any of the contact points you provide to us for any of the aforementioned purposes.

    Further to the above, we have set out below, in a table format, a description of all the ways we plan to use your Personal Information, and which of the legal bases we rely on to do so. We have also identified what our legitimate interests are where appropriate.

    Note that we may process your Personal Information for more than one lawful ground depending on the specific purpose for which we are using your data. Please contact us if you need details about the specific legal ground we are relying on to process your Personal Information where more than one ground has been set out in the table below.

    We strive to provide you with choices regarding certain Personal Information uses, particularly around marketing and advertising:

    • Promotional offers from us: You can opt-in to receive our marketing e-shot newsletter. You'll get all the latest industry news and offers from Yotspot. You can unsubscribe from this at any time. We may use your Identity, Contact, Technical, Usage and Profile Data to form a view on what we think you may want or need, or what may be of interest to you. This is how we decide which products, services and offers may be relevant for you (we call this marketing). You will receive marketing communications from us if you have requested information from us or purchased the Services from us and you have opted-in to receiving that marketing.
    • Third-party marketing: We will get your express opt-in consent before we share your personal data with any third party for marketing purposes.
    • Opting out: You can ask us or third parties to stop sending you marketing messages at any time by contacting us via e-mail or by following the opt-out links on any marketing message sent to you.

    How can I stop receiving cookies from Yotspot?

    If you wish to reject cookies on Yotspot you can do so by going to the privacy settings in your browser. Please note by not accepting cookies you will be able to access those parts of our Website available to the general public, but not some of the Website's features or services, and you may have a less satisfactory experience.

    What is a cookie?

    A cookie is an alphanumeric identifier which we transfer to your hard drive through your web browser when you visit our Website. It enables our own system to recognize you when you visit our Website again and improve our Services by seeing which areas and features are most popular, to personalise the Website and improve the Website experience, to allow you to visit the Website without re-entering your member ID and/or password, and to track and complete transactions you have requested.

    This traffic information can be used to enhance the content of our Website and make your use of it easier. If you wish to reject our cookie, you can configure your browser to do so.

    If you click on adverts, blogs and links displayed on Yotspot you may be directed to external sites. These 3rd party external sites may use cookies which are not used by us.

    Web Beacons

    "Web Beacons" (also known as Internet tags, pixel tags, single-pixel GIFs, clear GIFs, invisible GIFs, 1-by-1 GIFs, and Web bugs) are tiny graphic files placed on a web page which send a signal when a user has visited that page, allowing the Website to collect standard access information, such as time and date of a page view, and a description of the page on which the web beacon resides. We use web beacons to help manage the effectiveness of our online advertising and to gather access information, such as counting the users who have visited those pages and compiling aggregated statistics about site usage.

    Our web beacons do not contain any Personal Information and we do not link web beacons to Personal Information about you.

    Change of purpose

    We will only use your Personal Information for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us.

    If we need to use your Personal Information for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.

    Please note that we may process your Personal Information without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.

    SMS Text Service

    By creating a Yotspot profile and Opting into this privacy policy on sign up, you agree to allow CBMG to send you a SMS text message when you re set your password and when you are an employer and you login from a different location. When you reset your password we will send your new password via SMS text message to the number you have on your Yotspot profile. When you are an employer and you login from a different IP than your last login, we will send you a verification code via SMS text message that you can enter to unlock your account.

    5. Disclosures of your personal data

    Disclosure of Personal Information

    We do not rent, sell, or share personal information about you with other people or non-affiliated companies without your prior consent except:

    1. As necessary to complete a transaction you have requested. For example when you click "I'm Interested" on a particular position or job offer you accept that your Personal Information contained on your "Yotspot Crew Profile" will be disclosed to that employers account. When clicking "I'm Interested", your profile, data and CV will be transferred to the relevant employer account who may download and retain a copy of your CV or distribute it to third parties.

      "Employer Account" means any registered account which is used by Yacht Owners, Captains, Recruitment Agencies, Management Companies and Representatives for the purpose of accessing our membership service called The Yotspot 24/7 Account (Crew Database).

      While CBMG makes every effort to limit access to our recruitment software to legitimate users we cannot guarantee that other parties will not gain access. You acknowledge that we cannot control the use of your data, profile and CV by third parties who access Yotspot and that once your profile, CV and data has been transferred to an Employer Account, CBMG is not able to retrieve it, delete it or ensure how it is used by the individual or entity that uses such Employer Account.

      A second example of CBMG having to share data as necessary to complete a transaction you have requested is if you request to join Crew Pass Ltd via Yotspot, request to display your Crew Pass Ltd Status Information on your Yotspot Crew Profile, or request to perform a background check on a user. In such circumstances your data will be shared with Crew Pass Ltd.
    2. By obtaining an active "Yotspot Crew Profile" and having your profile set to being visible to employers (within crew search) you agree that your profile (and corresponding Personal Information) will be accessible and transferable to users with an Employer Account who search our database and may wish to contact you about jobs and opportunities.
    3. By obtaining an active "Yotspot Crew Profile" you agree that if a user with an Employer Account wishes to perform a background check on you, then your e-mail address and Yotspot ID only will be transferable to Crew Pass Ltd for the purpose of sending you a permission request to perform a background check. Crew Pass Ltd will not perform a background check without your express permission. Crew Pass Ltd's Privacy Policy can be seen here.
    4. By completing and filling in a Yotspot Connect App Profile ("Yotspot Connect App Profile") you agree that your profile (and personal information) will be accessible and transferable to other users of The Yotspot Connect App who you allow to follow you. You also agree that any user of the Yotspot Connect App will be able to see your name and any profile picture you upload even if you have not allowed them to follow you. Users that you allow to follow you will have full access to all data you upload to your profile.

      While CBMG makes every effort to limit access to the Yotspot Connect App to legitimate users we cannot guarantee that other parties will not gain access. You acknowledge that we cannot control the use of your data by third parties who access the Yotspot Connect App. Once your data has been transferred to another user of the Yotspot Connect App, CBMG is not able to retrieve it, delete it or ensure how it is used by the individual or entity that uses the Yotspot Connect App.
    5. If you link your profile to a Yacht/Vessel by entering a "Yacht Name" or MMSI number users that you have allowed to follow you will be able to see what Yacht/Vessel you have linked to and will also be able to see the Yacht/Vessel's location via our built in Marine Traffic integration. You must not link your profile to a Yacht/Vessel if:
      1. You do not want other users to be able to see the name of the Yacht/Vessel's and/or its location; or
      2. This is against any agreement you have made with your current employer and/or management company.
      3. You do not want to appear in that Yacht/Vessels Crew List on the Yotspot Connect App. Users that link to a Yacht/Vessel will appear in the Vessels "My Crew List". This is not an official crew list, neither is it associated with the Yacht/Vessel in any way. CBMG shall have no liability for the accuracy of the information and cannot be held liable for any third party claim or losses or damages arising out of or in connection with the display of such information via the Yotspot Connect App.
    6. As necessary to perform internal analyses and business functions. Examples include hosting our web servers, backing up to Amazon Cloud, Stripe processing Card payments, Cloudinary Video Management Platform, Octobat, Xero accounting software, Hubspot, Breckenridge & Viana Limited, Bronco and THB Accountants.
    7. As part of a business transfer.
    8. When required by law or permitted to protect our rights, property, or safety or that of our customers, or to prevent fraud, or to protect against abuse, misuse or unauthorized use of our Website or Services.

    These circumstances are explained as follows:

    • Consent. Unless you choose to do so, we will not disclose your personal information to third parties. With your consent, we may disclose your personal information to third parties so that they may provide you with products and services that you have requested.
    • Transaction Processing and Business Functions. We may share necessary personal information with third-party vendors who assist us in performing internal functions necessary to operate our business, or who assist us in processing and completing transactions that you have requested. If we use third-party vendors to assist us in performing these functions, the third parties may not use or disclose your Personal Information for any other purpose.
    • Internal Analysis. We may use Personal Information for our own internal purposes, such as to estimate our audience size, measure aggregate traffic patterns as well as to understand demographic, customer interest, and other trends among our users. We may outsource these tasks and disclose Personal Information about you to third parties, provided their use and disclosure of your personal information is restricted to performance of such tasks.
    • Business Transfers. Information about our users and the Services is one of our most important business assets. We may transfer our customer database, including Personal Information, to a third party who acquires all or substantially all of the assets or stock in our company or our Services whether by merger, acquisition, reorganisation or otherwise.
    • Protection of CBMG and Others. We may release Personal Information in the good faith belief that release is appropriate and necessary to comply with legal process or authority including a lawful subpoena, warrant or court order, or to enforce or apply our policies, to initiate, render, bill, and collect for amounts owed to us, to protect the rights, property, or personal safety of CBMG, our users, our employees, or the public, or if we reasonably believe that an emergency involving immediate danger of death or serious physical injury to any person requires disclosure of communications or justifies disclosure of records without delay.

    Important information regarding your current Employer

    Your current employer may have an Employer Account with CBMG or be a visitor to www.yotspot.com or be a customer of one of our clients. Your current employer may discover you are looking for work if you have a "Yotspot Crew Profile" on our Website. CBMG cannot restrict who has access to profiles, data and CVs and cannot be held responsible for any eventuality.

    Important Information about making your profile visible to employers within "Crew Search"

    Crew Search is an important part of the job seeking process and could dramatically increase your chances of securing employment. Crew Search makes your profile visible to Employer Accounts and means they can access your profile even if you have not applied to their role by clicking "I'm interested".

    You can 'opt-out' of, or 'opt-in' to, Crew Search at any time by changing the setting in your profile.

    Crew Search also allows any visitor to www.yotspot.com to see your profile in a limited capacity. If you 'opt-in' to Crew Search this means any visitor to www.yotspot.com can see your main photo and all data uploaded to your profile with the following sections locked: Full Name, Contact Details, Passport & Visas, Downloads and names of Yachts and Companies you list in your experience or seatime section. You should not create a Yotspot profile or maintain an active profile if you do not want your profile to appear publicly in a limited capacity (as outlined above) on the Wesbite.

    Important information about Crew Pass Ltd

    Crew Pass Ltd is a third party that offers background checking services. Please see section 5(1), section 5(2), and section 5(3) above regarding our disclosure of data to Crew Pass Ltd.

    Crew Pass Ltd will not perform a background check without your express permission.

    For the avoidance of doubt, CBMG gives no representation or warranty as to the performance, suitability, entitlement or character of any users checked via Crew Pass Ltd or any users that display an "Approved" Crew Pass status and does not give a representation or warranty in respect of any users having or not having a criminal record. Users acknowledge and agree that they will not rely on any information they receive from CBMG and/or Crew Pass Ltd and shall carry out their own investigation, due diligence, criminal background checks and reference checks in respect of any users in order to reach a decision as to the users suitability for a placement prior to offering the crew any placement.

    Important Information about your Yotspot.com profile, Yotspot Connect App Profile and CV

    You acknowledge that Personal Information posted on your profile and on your CV may be viewed, accessed, downloaded and stored by users around the world, including users in countries outside of the EU and in countries that may not have laws and legislation that guarantees adequate protection and safeguarding of personal information as defined by your country of residence.

    While CBMG makes every effort to safeguard your information from unauthorised access or inappropriate use, CBMG does not control these third party users and therefore cannot guarantee who has access to your data. We cannot control the retention, privacy or use of your profile, data and CV that has been viewed or downloaded by third parties.

    The Yotspot Connect App accesses and stores contact information on our server to send you real time notification of nearby friends.

    Video Interview Uploads

    All videos uploaded are held for 30 days. You are free to delete your video at any time within your account. If you do not delete your video it will be automatically deleted after 30 days.

    References

    It is your responsibility to ensure that your reference has given you their permission for you to use them as a reference and for CBMG to store their information for referencing.

    We require all third parties to respect the security of your Personal Information and to treat it in accordance with the law. We do not allow our third-party service providers to use your Personal Information for their own purposes and only permit them to process your Personal Information for specified purposes and in accordance with our instructions.

    Sharing your profile

    Yotspot gives you the opportunity to share your profile publicly with a unique link. By sharing this link you are allowing anyone who uses that link full access to your profile and all data uploaded to the profile. If you enter this link into any public domain this link can be indexed by google. This means your profile can be found within google search results and the contents can be accessed publicly by anyone who finds this link. You should not share this link if you do not want your data to be accessed publicly. If you share this link CBMG cannot restrict who has access to your profile, data and CVs and cannot be held responsible for any eventuality.

    Access and Control of Personal Information

    If you are a registered user of our Services and/or the Yotspot Connect App, you may view, correct, or delete your Personal Information by logging into the Website and editing your profile. You may request for your Personal Information to be completely removed from our system at any stage.

    6. International transfers

    Whenever we transfer your Personal Information out of the UK where we use certain service providers, we may use specific contracts approved for use in the UK which give personal data the same protection it has in the UK.

    Personal Information will be stored and processed on our computers in accordance with English law. If you object to your Personal Information being transferred or used as described in this privacy policy, please do not register for the Services.

    Please contact us if you want further information on the specific mechanism used by us when transferring your personal data out of the UK.

    7. Data security

    We have put in place appropriate security measures to prevent your Personal Information from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your Personal Information to those employees, agents, contractors and other third parties who have a business need to know. They will only process your Personal Information on our instructions and they are subject to a duty of confidentiality.

    Your account information and access to our Services is accessible only through the use of an individual user ID and password. To protect the confidentiality of Personal Information, you must keep your password confidential and not disclose it to any other person. You are responsible for all uses of our Website and Services by any person using your account user ID and password. Please advise us immediately if you believe your account user ID and password have been misused.

    We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

    8. Data retention

    How long will you use my Personal Information for?

    We will only retain your Personal Information for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your Personal Information for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

    Event Data on the Yotspot Connect App:

    If you accept an invite to an event on the Yotspot Connect App then the host and other invitees can see you are marked as attending that event. You should not accept an event invitation on the Yotspot Connect App If you do not wish the host or other invitees to see this data.

    Location Data when using the Yotspot Connect App:

    Due to the nature of the Services, the Yotspot Connect App will make use of location data sent from your devices. You can turn off this functionality at any time by turning off the location services settings for the Yotspot Connect App on the device.

    If you use Yotspot Connect App, you consent to us and our affiliates and licensees transmission, collection, retention, maintenance, processing and use of your location data and queries to provide and improve the location-based functionality of the Yotspot Connect App.

    When you use the Yotspot Connect App, you acknowledge that the Services require the use of your location data. Your estimated location will be made available to other Yotspot Connect App users at any time. Your estimated location will be available to other users of the Yotspot Connect App in displaying the distance you are from other Yotspot Connect App users. You will also allow other Yotspot Connect App users to see the name of the town in which you are currently located. While CBMG will never display your precise geographical location it is possible to triangulate your position if 3 separate users congregate the displayed distances they are from you. You must not download, install or use the Yotspot Connect App if you want to keep your location private.

    How to delete or amend your Yotspot.com account

    You can delete your account at any time. You can do so by logging in and clicking "Delete My Account" or "Delete Profile" in your profile. You can also edit your profile or delete files at any time by logging in. Please note that any third party or Employer Account who has had access to your profile, data or CV may have kept a copy.

    No fee usually required

    What we may need from you

    We may need to request specific information from you to help us confirm your identity and ensure your right to access your Personal Information (or to exercise any of your other rights). This is a security measure to ensure that Personal Information is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

    Time limit to respond

    We try to respond to all legitimate requests within one month. Occasionally it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

    LAWFUL BASIS

    Legitimate Interest means the interest of our business in conducting and managing our business to enable us to give you the best Services and the best and most secure experience. We make sure we consider and balance any potential impact on you (both positive and negative) and your rights before we process your Personal Information for our legitimate interests.     You have the right to:
